Hasani: “Kurti cannot exclude the Serb List from the coalition, the Constitution does not allow it.”

The former president of the Constitutional Court, Enver Hasani, stated that Prime Minister Albin Kurti, in order to form a new government, must inevitably form a coalition with the Serb List.

He said that excluding the Serb List is not allowed by the Constitution.

Meanwhile, he explained how non-Albanian ministers can be appointed.

“There are two situations recognized by the Constitution: first, for a non-Albanian minister, consultation with those parties is required, if they are a member of the Assembly, meaning if they are a deputy, or if they are elected from outside, because the government can be formed by people outside the electoral process. In that case, a formal decision is required from those who represent the communities, meaning those elected by vote, which refers to the Serb List. Even before this time, there was a constitutional violation because when Nenad Rašić was appointed minister, he wasn’t a deputy, as far as I know. Now he is a deputy, but if they want to elect him, they have two options: either the Serb List or Rašić’s party. If they want to choose him internally, the prime minister consults with them and decides on his own, there is no problem. But if they don’t want to elect Rašić, even from the Serb List, which is a deputy in the Assembly, they can do it from outside. He can do it, but it violates the Constitution,” Hasani declared on Klan.

According to preliminary results, LVV needs at least three more deputies, even if they join deputies from non-majority communities, excluding the Serb List, in order to form the government.

Hasani stated that for mandating the winning party to form the new government, the role of the country’s president is crucial.
