The Association of Journalists of Kosovo (AJK) has welcomed the decision of the Basic Court approving the lawsuit filed by the Kosovo Law Institute (KLI) regarding the election of the chairperson of the Independent Media Commission (IMC) earlier this year.
The Basic Court declared unlawful the decision of the IMC Board to appoint Besnik Berisha as Chairperson during the meeting held on January 17, 2025.
“KLI also requested the declaration of unlawfulness and the annulment of paragraph 2 of Article 3 of the Rules of Procedure of the Independent Media Commission, a paragraph that had been added to the regulation at the IMC meeting on January 17. AJK considers that Mr. Berisha’s appointment was carried out unlawfully, in an open attempt at political control of this institution by the Government of Kosovo,” the statement reads.
“The decision of the Basic Court issued today restores legality, and independent institutions must take into account the need for full respect of the applicable laws in important decision-making processes. AJK is committed to ensuring that the IMC remains politically independent, so that it can fulfill its constitutional role in monitoring and regulating television and radio broadcasters in Kosovo,” AJK stated.
