Constitutional Court Judge Radomir Laban Denied Request to Recuse Himself Following Osmani’s Statements

Radomir Laban, a judge of the Constitutional Court of Kosovo, requested to recuse himself from the decision-making process in the case clarifying the constitution of the Kosovo Assembly. This followed statements by President Vjosa Osmani, who had claimed that Laban poses a threat to national security.

The Court denied Laban’s request just two days after Osmani publicly expressed her concerns.

“On 7 August 2025, Judge Radomir Laban requested recusal from cases KO193/25, KO196/25, and KO215/25. On the same day, the Court unanimously rejected the recusal request,” the judgment states.

Osmani had previously withdrawn her application for clarification regarding the Assembly’s constitution on 5 August, citing Laban’s appointment as reporting judge for the case. She argued that:

“Based on confirmed information regarding Judge Laban’s past activities in 2018, 2021, and 2024, which were reported to our security institutions, he represents a risk to the national security of the Republic of Kosovo and is involved in activities against the constitutional order.”

Despite these claims, Laban, a Serb community judge, was officially invited by Kosovo state leaders to participate in the 17th Independence Day celebrations, even though the Kurti government and Vetëvendosje have raised concerns about his alleged links to Milan Radojičić.
