The Constitutional Court of Kosovo has published the full ruling regarding the case of the Assembly.
In point 114 of the decision, the Court underlined that the agenda of the constitutive session, determined by the chairperson of the previous legislature in coordination with political party leaders, represents the sole content of the session.
The Court cited Article 8(4) of the Rules of Procedure of the Assembly, which specifies that the agenda of the constitutive meeting must include only:
- Formation of the Provisional Commission for Verification of Quorum and Mandates
- Oath of deputies
- Election of the Speaker of the Assembly
- Election of the Deputy Speakers
According to the ruling, this agenda is the exclusive framework of the constitutive session and must be strictly respected by the presiding officer, without deviations or procedural interventions that contradict the constitutional order.
The Court had previously, on August 8, 2025, ruled that Members of Parliament must elect the Speaker of the Assembly through an open vote within 30 days after the entry into force of this decision. It also declared all sessions held between June 27 and July 26, 2025 as invalid.
The ruling followed the Court’s finding that deputies elected in the February 9 elections failed to comply with its earlier June 26 decision, making subsequent sessions legally void.
