Decisive Week – MPs Await Key Ruling from the Constitutional Court

This Friday, August 8, marks the expiration of the temporary injunction issued by the Constitutional Court of Kosovo, which has barred Members of Parliament from undertaking any decisions or actions related to the constitution of the Assembly.

The injunction came after an unprecedented political deadlock in the Assembly, where MPs failed 54 consecutive times to conclude the constitutive session, which originally began on April 15. The deadlock has centered on the third item of the agenda – the election of the Speaker of the Assembly.

The Constitutional Court had previously ruled that the ninth legislature must be constituted within 30 days, but that deadline passed without resolution. In response, the Court imposed a two-week temporary measure on July 27, effectively freezing parliamentary activity.

Despite the clear timeline, the Assembly’s leadership failed to meet its constitutional obligation. Even the two additional session continuations, held on the final day of the deadline, proved fruitless.

The legislative impasse began after Vetëvendosje (VV), the winning party of the elections, proposed Albulena Haxhiu as Speaker. However, she failed to secure enough votes in multiple rounds of voting.

Later, with the support of the acting session chair Avni Dehari, also from VV, the party attempted to change the voting method from open to secret ballot. This procedural shift required the formation of a special commission — which itself failed to garner enough votes nearly 50 times.

The outgoing opposition bloc has repeatedly denounced VV’s actions as unconstitutional, arguing that the attempt to change the voting procedure bypasses established rules and parliamentary norms.

With the temporary freeze nearing its end, all eyes are now on the Constitutional Court, which is expected to clarify the legal path forward. The coming days will be crucial in determining whether Kosovo will finally move beyond the parliamentary deadlock or plunge deeper into a constitutional crisis.
