Democratic Party of Kosovo Takes Energy Regulator (ZRRE) to Court

The Democratic Party of Kosovo (PDK) has filed a lawsuit today at the Basic Court in Prishtina against the Energy Regulatory Office (ZRRE) over its decision to liberalize the electricity market.

According to a Facebook statement by PDK MP Abelard Tahiri, the decision was made without a fair, legally grounded, and inclusive process, and it is already producing serious and irreversible consequences for more than 1,300 local businesses and over 140,000 workers employed by these enterprises.

The Democratic Party of Kosovo, remaining committed to protecting the public interest and the rights of citizens and businesses in the country, has today submitted a lawsuit to the Basic Court in Prishtina requesting the annulment of the decision to liberalize the electricity market in Kosovo.

This decision, made without a proper, lawful, and inclusive process, has already begun to cause serious and irreversible consequences for over 1,300 local businesses and more than 140,000 workers. The effects of this decision are seriously threatening the country’s economic stability by raising prices, fueling inflation, and putting many businesses at risk of bankruptcy.

Alongside the main lawsuit, PDK has also requested the court to issue a security measure—an immediate suspension of the implementation of the decision—in accordance with Article 100 of Law No. 08/L-182 on Administrative Conflicts, to prevent further daily damages.

In this case, PDK has acted as the plaintiff with full legal standing, defending the collective interest of Kosovo’s citizens and businesses. The Energy Regulatory Office’s decision has infringed not only the legal rights of consumers with an annual turnover over €10 million or more than 50 employees, but it has also directly harmed the broader economic interests of all citizens of the Republic of Kosovo.

The preliminary procedure followed at ZRRE has confirmed our long-standing concerns: the institution did not issue a final administrative decision regarding market liberalization, but instead used a simple notice to impose a heavy burden on the private sector. This was done intentionally to avoid judicial oversight.

In line with the rule of law and based on concrete evidence and legal arguments, PDK has taken all necessary legal steps to initiate this court case in defense of the public interest and justice.

We expect the court to objectively evaluate our request for a security measure and to suspend the implementation of this decision until a final judgment is made on its legality.

At the same time, we welcome today’s decision by the Commercial Court, which approved a private company’s request to suspend the decision. This ruling represents an important precedent, and we hope it will be upheld in all judicial instances, serving as a basis for unifying court practices in similar cases.

The Democratic Party of Kosovo remains committed to defending the interests of citizens, the private sector, and the constitutional order in the Republic of Kosovo.
