EU Envoy Aivo Orav Reacts to Supreme Court Ruling, Condemns Government’s Attacks on Judiciary

The European Union Ambassador to Kosovo, Aivo Orav, has responded to yesterday’s Supreme Court ruling, which found that acting ministers who also serve as MPs cannot issue new administrative acts or bylaws, deeming such actions unconstitutional.

In a post on X (formerly Twitter), Orav revealed that the heads of EU missions in Kosovo have held discussions regarding the legal and political implications of the Supreme Court’s decision.

The ambassador issued a strong condemnation of the Kosovo government’s reaction, particularly targeting acting Minister of Finance Hekuran Murati, for his criticism and perceived attacks against the judiciary.

“Attacks against individual judges and political interference in the judiciary are unacceptable,” Orav stated.

This comes after the caretaker government harshly criticized the ruling, labeling it as “arbitrary” and “one-sided.” The ruling in question annulled an administrative instruction issued by Murati, who had returned to parliament as an MP following the February elections.

The Supreme Court emphasized that a caretaker government may only perform necessary and pre-approved functions, not introduce new normative acts, especially not by individuals simultaneously holding dual executive-legislative roles.

The European Union’s reaction underscores growing concerns over the rule of law and judicial independence in Kosovo at a time when the country is undergoing significant institutional and political uncertainty.
