Gashi Calls for New Constitutional Court Ruling to Restore Stability, Replacing 2014 Decision

Arben Gashi, a deputy from the Democratic League of Kosovo (LDK), has emphasized the urgent need for a new ruling by the Constitutional Court that would bring institutional stability and cooperation.

Gashi stressed that for Kosovo to achieve stable governance and functional representation, it is crucial to build a culture of political cooperation and compromise.

He stated:
“The Constitutional Court must issue a new decision replacing the 2014 ruling regarding the election of the Speaker of the Assembly, restoring the situation in line with the spirit and constitutional rules. The Court should revert the one-sided change to the voting procedure, which without formal prior approval of the deputies is unconstitutional and does not reflect the Assembly’s democratic will.”

Gashi outlined a proposed model based on the principle of relative rights instead of absolute rights:

  • The party or coalition winning the elections has 30 days to form a majority and elect the Speaker.
  • If unsuccessful, the Assembly deputies have 15 days to elect a Speaker from among themselves by majority vote.
  • If still no Speaker is elected, the President must call for extraordinary elections within 45 days, as per Article 84, paragraph 2 of the Constitution, to ensure democratic functioning.

This model:

  • Aligns with the spirit of Kosovo’s Constitution
  • Respects the winning party’s priority without turning it into a process hostage
  • Upholds the principle of parliamentary majority, the core of representative democracy
  • Eliminates absolute exclusivity and arrogance

Gashi concluded that such reform would foster greater institutional respect, political maturity, and willingness to compromise, steering Kosovo away from political deadlock and towards balanced functionality.
