The Basic Prosecution in Gjakova has requested 30 days of pre-trial detention for two individuals, Xh.P. (Xheladin Pozhegu), 46, and A.M. (Albert Margegaj), 49, arrested in connection with the tragic deaths of two construction workers on July 21.
Details of the Fatal Accident
The incident occurred when Hazir Jakupaj, 48, and Daut Bajraktari, 50, fell from the third floor of a building under construction in Gjakova, as reported by Gazeta Sinjali. The victims were working on the building when, for reasons still under investigation, the board they were standing on broke, causing them to fall from a height of nine meters. Both succumbed to their injuries.
The prosecution alleges that Xh.P., as the responsible person of the legal entity NTSH “Sh….” Sh.P.K. and investor/employer, and A.M., as the responsible person of “M.G.” Sh.P.K. and contractor, failed to install necessary protective equipment and ensure its use, acting negligently and in violation of safety regulations.
Specific Allegations and Legal Basis
According to the prosecution’s request, the defendants are suspected of “Destruction, damage, or removal of protective equipment and endangering safety at the workplace” under Article 358, paragraph 7, in conjunction with paragraphs 3 and 2 of the Criminal Code of the Republic of Kosovo.
The request details that the victims were working on demolishing external concrete boards from a platform installed outside technical specifications. They were reportedly not wearing protective vests or helmets, nor were safety ropes in place. Furthermore, the area where the victims fell lacked scaffolding or protective railings that would have prevented their fall.
The medical report from Gjakova Regional Hospital dated July 21, 2025, confirmed the deaths of H.J. and D.B. as a result of injuries sustained from the fall at the workplace.
