Former President of the Constitutional Court, Enver Hasani, stated that what happened today in the Kosovo Assembly regarding the election of deputy speakers from the non-majority community was entirely against the Constitution of Kosovo.
He emphasized that the majority community cannot be asked about the constitutional rights of non-majority communities.
Hasani said that MP Nenad Rashiq has no right and cannot be proposed as Deputy Speaker of the Assembly of Kosovo on behalf of the Serb community.
According to him, such a proposal can only be made by the parliamentary group of Serbs in the Kosovo Assembly.
“Mr. Rashiq has no right to be proposed, neither according to the Constitution of Kosovo nor according to the Rules of Procedure of the Assembly. The voting must be done by the majority of the Serb community, something that the Constitution and the Rules of Procedure of the Assembly clearly define. The Rules of Procedure is the only sub-legal act fully harmonized with the Constitution of Kosovo and serves as a measuring parameter for evaluating the constitutionality of the acts of the Kosovo Assembly, if they end up in the Constitutional Court,” he told Nacionale.
