The Kosovo Democratic Institute (KDI) has expressed concern that even on the 59th attempt, the Assembly has not managed to complete the constitution process.
Although the Speaker of the Assembly and three deputy speakers from the largest parliamentary parties have been elected, KDI notes that during the process of electing the two deputy speakers from non-Serb minority communities, there were procedural violations by the Speaker of the Assembly. According to the statement, this occurred through the implementation of a separate voting procedure for the candidate from the Serb community and the candidate from other minority communities.
KDI emphasizes that Constitutional Court rulings have established that the constitution of the Assembly must also follow previous practices, according to which all five deputy speakers are voted in two separate packages.
“The spirit of the Constitution of the Republic of Kosovo (Article 67), the Assembly Rules of Procedure (Article 12), and Court rulings fundamentally underline the need for consensus and inclusivity in the election of the Speaker and deputy speakers.”
“Deviation from this procedure not only undermines the process of constituting the Assembly but also hinders the implementation of constitutional obligations to guarantee the inclusion of the Serb community in the institutions of the Republic of Kosovo.”
KDI calls on parliamentary parties to act with institutional responsibility and prioritize the state interest, committing to finding a solution that completes the Assembly’s constitution process as soon as possible, in accordance with the spirit of the Constitution, the Rules of Procedure, and the Constitutional Court rulings.
