President of Kosovo, Vjosa Osmani, will hold a press conference at 12:00 PM on Tuesday, following her announcement that the Presidency will submit comments to the Constitutional Court regarding the ongoing process of constituting the Assembly of Kosovo.
Bekim Kupina, Osmani’s media advisor, confirmed that the President’s position is that no one has the right to block institutions or the state, in line with Article 57(4) of the Constitution, which emphasizes that the rights of communities must be exercised without violating the law or the rights of others.
The Constitutional Court previously issued a temporary measure until September 30, 2025, in response to a request from the Serbian List deputies concerning the election of deputy speakers from non-majority parties. The Court’s decision was made by Chair Nexhmi Rexhepi and six judges.
The petition, filed by Serb List deputies, challenges the constitutionality of the Assembly’s session records and decisions from August 26 and 28, 2025. They requested a temporary measure to halt unconstitutional actions by the Assembly Speaker, warning that failure to act could lead to the formation of unconstitutional government institutions, harming Kosovo’s legal and democratic order.
The constituent session of the Assembly was closed on August 28, 2025, by Speaker Dimal Basha, despite the non-election of a deputy speaker from the non-Serb community parties. Emilja Rexhepi was elected deputy speaker from non-Serb parties, while the Serb community deputy speaker position remains contested.
Kosovo’s Constitution specifies that the deputy speaker must come from reserved or guaranteed seats for the Serbian community, while the Assembly’s Rules of Procedure require the candidate to be proposed by a majority of Serb community deputies. Attempts to elect alternative candidates from the Serbian List, including Sllavko Simiq, have failed after three voting rounds, leaving the position unresolved.
President Osmani’s legal team has been analyzing the process since September 1, 2025, preparing comments for submission to the Constitutional Court.
