The U.S. Ambassador to Kosovo, Jeff Hovenier, emphasized the critical importance of sentencing in the criminal justice system during the launch of the Kosovo Supreme Court’s Guidelines for Measuring Sentencing. He stressed that both international and local reports indicate Kosovo’s justice system often imposes overly lenient and disproportionate sentences.
“Sentencing is one of the most crucial stages of criminal justice,” Hovenier stated. “This general guideline provides a clear framework for imposing sentences for criminal offenses in Kosovo. While Kosovo adopted its first sentencing guidelines six years ago, local justice officials are still a model for countries in the region. However, significant work remains to make this guide effective and enforceable. International and local reports indicate that Kosovo’s justice system still frequently issues lenient or disproportionate sentences, underscoring the urgent need to fully implement these guidelines.”
Hovenier further stressed that justice can only be fair when it is truly just. “By applying this guide, you show the public that your decisions are based on the best international standards and practices in justice. The U.S. has gone through a similar process, learning from it over time. No country gets it perfect, but the U.S. experience with sentencing guidelines has helped reduce unfair discrepancies across jurisdictions, creating a more stable system that balances judicial discretion with accountability.”
The U.S. Ambassador reiterated Washington’s unwavering support for Kosovo, saying, “Since Kosovo’s independence, and even before it, the United States has stood by your side. We will continue to do so.”
The President of Kosovo’s Supreme Court, Fejzullah Rexhepi, also highlighted the significance of this moment for Kosovo’s justice system. “This document is the result of long-term efforts and reflects our commitment to ensuring consolidated justice and uniform practices in line with the current legal framework.”
Rexhepi noted that the new guidelines, compared to the 2018 version, provide more specific clarifications for nearly every section of the Penal Code. “Current issues with sentencing consistency, whether within the same court or across different courts, have significant consequences, as they impact citizens’ trust in the impartiality and professionalism of the judiciary. This, in turn, affects the public image of the justice system.”
He added that these new sentencing guidelines aim not only to strengthen the rule of law but also to boost citizens’ trust in the judicial system and enhance their sense of security.
