Krasniqi clarifies: The caretaker government cannot propose the budget for the new legislature

Political analyst Albert Krasniqi has clarified that the caretaker government, elected by the previous legislature, does not have the legal authority to propose the Annual Budget Bill for the new legislature.

According to Krasniqi:

  • The new Assembly, which has not yet elected a new government, cannot approve laws without an executive to implement them.
  • The Assembly Rules of Procedure stipulate that the draft budget must be reviewed by parliamentary committees, which have not yet been formed. Any attempt to bypass this process would violate the Rules.
  • Article 123 of the Rules allows only procedural deadline exceptions, but not fundamental actions such as committee review or proposal by the legitimate government.

Krasniqi emphasizes the distinction between:

  1. A resigning government – continues exercising functions after the resignation or dismissal of the Prime Minister, with a functioning Assembly, established committees, and communication channels between government and parliament. This government can propose the draft budget.
  2. A caretaker government – elected by the previous legislature, without institutional ties to the new Assembly. According to the Law on Government, this government cannot propose the budget bill for the new legislature.

Krasniqi concludes that following procedures is not a formality, but essential for the separation of powers and the proper functioning of democratic institutions.
