Law Commission Rejects Democratic Party’s Request to Dismiss President Begaj

The Law Commission of Albania has rejected the Democratic Party’s (PD) request to dismiss President Bajram Begaj from office.

The decision was adopted with nine votes from the ruling majority, and the Commission’s report will now be forwarded to the plenary session for further review.

During the meeting, PD representative Gjin Gjoni presented the opposition’s arguments in favor of the President’s dismissal, listing what he described as multiple constitutional violations allegedly committed by President Begaj while exercising his duties.

According to Gjoni, the decree for partial elections in the Municipality of Tirana was unconstitutional, representing an overreach of presidential powers.

“The PD parliamentary group has submitted the request to initiate parliamentary procedures for the dismissal of President Begaj. We are convinced that Begaj can no longer represent the unity of the people or continue as head of state. We have concluded that he has committed seven constitutional and legal violations—enough grounds for his removal,” Gjoni stated.

Among the alleged violations, Gjoni listed:

  • Issuing an unconstitutional decree for partial elections in Tirana;
  • Creating a constitutional deadlock regarding the local elections in the municipality;
  • Undermining the legitimacy of the electoral process and usurping the judiciary’s authority.

Despite these claims, the Law Commission voted down the request, concluding that there was no sufficient legal basis to move forward with the dismissal process.

The issue will now be sent to Parliament, where lawmakers will decide whether the motion should proceed to further deliberation or be formally closed.
