Members of Parliament from the Democratic League of Kosovo (LDK), Alban Zogaj and Besian Mustafa, have officially submitted to the Special Prosecution of Kosovo the decision of the Supreme Court regarding the contested fiscal devices directive.
The Supreme Court overturned an administrative instruction issued by the acting Minister of Finance, Hekuran Murati, declaring it unlawful.
The overturned directive, published in the Official Gazette on April 16, pertained to the use of electronic fiscal devices, fiscal systems, and related software. Notably, it was approved a day earlier by Murati, after he had already been sworn in as a Member of Parliament, following the February elections.
According to the Supreme Court’s ruling:
“A caretaker government is authorized to perform only essential activities foreseen in the Government’s Annual Work Plan and the annual Budget Law, excluding the adoption of new normative secondary legislation.”
This move by LDK signals a push for accountability, alleging that the outgoing government overstepped its constitutional limits by adopting new binding regulations while in a caretaker capacity.
The Special Prosecution is expected to evaluate whether this action constitutes a breach of legal and constitutional procedures.
