LVV after the Constitutional Court ruling: Arbitrary decision undermining democracy

Following the publication of the Constitutional Court’s ruling on the election of the Speaker of the Assembly, the political party Vetëvendosje (LVV) reacted, describing the decision as a “clear overreach of jurisdiction” and “the creation of a new rule through judgment without constitutional basis.”

In LVV’s statement, it is said that “Exceeding jurisdiction is not justified by anything. The decision is delayed and demonstrates the inability to justify this arbitrary act, which directly undermines democracy.”

According to LVV, the Court did not provide any new arguments, merely repeating the opposition’s narrative about analogies with other Assembly elections, while the Constitution clearly defines the procedures related to the election of the President and cannot be used as a reference for other cases.

“The narrow limits of reasoning are a consequence of the broad overreaches the Court has allowed itself. It is unacceptable that for such an important decision, the Court did not seek international comparisons or opinions from peer courts, as is customary in sensitive constitutional cases.”

LVV also considers the thesis allowing a change in the entity that can propose a candidate for Speaker after 30 days to be unjust and dangerous, describing it as a preparation of a political terrain favoring the opposition and undermining the existing constitutional order.
