New IMC Regulation Defines Media Responsibilities During Election Campaigns in Kosovo

The Independent Media Commission (IMC) in Kosovo has adopted a new regulation outlining the obligations of media outlets during election campaigns. This regulation, passed during the Commission’s 12th regular meeting on December 16, 2024, aims to ensure fair and impartial media coverage during elections.

The regulation was developed with the support of the Kosovo Institute for Justice (IKD) and focuses on implementing Chapter VIII of the Law on General Elections, which outlines the media’s responsibilities toward political parties during election campaigns.

Key provisions include ensuring media outlets maintain neutrality and fairness when covering election-related content. Media organizations planning to cover the election campaign must notify the KPM no later than seven days before the campaign starts.

Advertising Guidelines

The regulation sets clear guidelines for political advertisements during the campaign, including allowed time slots (from 12:00 PM to 12:00 AM) and duration, with political ads limited to a maximum of 120 seconds. Media outlets are also required to provide a certain amount of free airtime for certified political parties, with specific time allotments based on the type of station (public vs. private).

Paid and Unpaid Political Advertising

For paid political advertisements, media outlets must publish their pricing lists one week before the campaign begins. They are also required to offer free advertising minutes to political parties, which must be distributed equally among them.

Debates, Surveys, and Election Day Restrictions

The regulation includes provisions regarding political debates, surveys, and the media’s conduct on Election Day. During debates, equal time must be given to all political parties, and any surveys or polls published during the election period must adhere to strict transparency guidelines. The regulation prohibits publishing poll results within 24 hours of the closing of voting stations.

On Election Day itself, media outlets are restricted from broadcasting campaign-related material but can report on the election process and any irregularities that may arise.
