Osmani Seeks Constitutional Court Interpretation on Consequences of Assembly Non-Constitution

Kosovo’s President, Vjosa Osmani, has submitted a request to the Constitutional Court seeking an interpretation of the legal consequences that might arise if the new Assembly is not constituted within the 30-day deadline set by the Constitution.

Preventive Measure for Democratic Functioning

In a press conference on Tuesday afternoon, Osmani emphasized that the request is preventive in nature and essential to ensuring the democratic functioning of the country’s institutions. She added that the current situation represents an unprecedented case in Kosovo’s political life, and the lack of consensus for the Assembly’s constitution within the constitutional timeframe has created serious legal ambiguity.

“Any non-compliance must have legal consequences, but these have not been clarified so far. Our request is essentially for the clarification of these consequences if the Assembly is not constituted on time. This is an attempt to prevent irreparable consequences for the constitutional order of the country,” Osmani stated.

No Political Agreement in Sight

The President assessed that there are no signs of any political agreement being reached within the remaining deadline, describing the situation as an “institutional clash of constitutional character.”

“No consensus or compromise for resolving this issue within the deadline is visible on the horizon,” she said, calling this a “conflict of constitutional competencies.”

According to the Constitutional Court’s judgment of June 26, the Assembly must be constituted within 30 days, a deadline that expires in four days.
