Osmani Submits 27-Page Request to Constitutional Court Amid Assembly Crisis; Former Minister Hyseni Criticizes Interim Measure Request

Kosovo President Vjosa Osmani has submitted a comprehensive 27-page request to the Constitutional Court, seeking an “assessment of the conflict between constitutional competencies” amid the ongoing political deadlock that has prevented the Assembly from being constituted within its 30-day constitutional deadline. Simultaneously, former minister Skënder Hyseni has strongly criticized Osmani’s request for an interim measure to suspend this deadline, calling it a potential “serious violation of the Constitution.”

President Osmani’s Seven Key Demands

Osmani’s request, secured by Express, states that her appeal to the Constitutional Court follows her persistent efforts to facilitate a political agreement for the Assembly’s constitution. Regarding the interim measure to suspend the 30-day deadline, the President asserts that it is necessary to prevent “irreparable damage” and is in the public interest.

The document concludes that the absence of a functioning Assembly, coupled with a caretaker government with limited powers and no parliamentary oversight, is risking the exercise of Kosovo’s sovereignty through its elected representatives, the form of governance, the separation of powers, and the values of the Republic of Kosovo.

President Osmani has therefore asked the Constitutional Court to:

  1. Declare the request admissible.
  2. Approve the request for an interim measure.
  3. Conduct a preventive (ex ante) assessment of the conflict of competencies between constitutional institutions in the event of the Assembly being constituted after the constitutional deadline.
  4. Resolve the constitutional conflict of competencies, including the legal consequences of the Assembly’s failure to constitute within the deadline set in Article 66 (1) of the Constitution and Judgment KO 124/25.
  5. Resolve the constitutional conflict of competencies, including the legal consequences of the Assembly’s constitution after the deadline set in Article 66 (1) of the Constitution and Judgment KO 124/25.
  6. Resolve the conflict of competencies, including the consequences for the exercise of the President’s competencies in relation to an Assembly that may be constituted after the deadline set in Article 66 (1) of the Constitution and Judgment KO 124/25.
  7. Clarify all other legal effects related to the non-constitution of the Assembly within the constitutional deadline.

Hyseni’s Strong Opposition to Interim Measure

Former minister Skënder Hyseni reacted sharply to Osmani’s request for an interim measure, viewing it as a move to prolong the current “stagnation.”

“Today, Tuesday, at 4:00 PM, a quasi-commanding request was sent to the Constitutional Court: ‘Issue a decision, an interim measure….’ Read: to continue the stagnation!” Hyseni wrote. He questioned the timing of the request, made almost at the end of the deadline.

Hyseni explicitly stated that “if this request is considered, the Constitutional Court will commit a serious violation of the Constitution of Kosovo!”
