Parliamentary Crisis Continues as Constitutional Court Yet to Review PDK and LDK Complaints

As political parties await a ruling from the Constitutional Court regarding the legality of procedures during the constitutive session of the Kosovo Assembly, the court has yet to begin reviewing the complaints filed by the Democratic Party of Kosovo (PDK) and the Democratic League of Kosovo (LDK).

Speaking to Gazeta Sinjali, Veton Dula, Secretary General of the Court, confirmed that both cases remain under preliminary processing:

“The requests from PDK and LDK are still in procedure,” Dula stated.

The PDK submitted its request to the Court on July 3, calling for a constitutional review of four actions taken during the Assembly’s constitutive session held on June 29 and its continuations on July 1 and 3. These actions include:

The call for proposals for members of the Commission for Secret Ballot,

The voting on the formation of that Commission,

The vote of the Commission itself,

The suspension of the session following the failure to approve the Commission.

PDK argues these steps violate the Constitution and a recent Constitutional Court judgment, which they claim created a new legal framework for how the Assembly should be constituted.

On July 4, LDK also submitted a separate request, contesting the continuation of the constitutive session after the Court’s ruling.
LDK official Shkëmb Manaj stated:

“In our view, this decision was made in violation of the Constitution and the Rules of Procedure of the Assembly.

The responsibility for constituting the Assembly lies with the largest parliamentary group, which must act responsibly, in cooperation with other political entities, and in line with the constitutional order and parliamentary procedures.

Institutional deadlock cannot be resolved through unilateral actions, but through dialogue, respect for the Constitution, and political consensus.”

The parliamentary stalemate has persisted for months, with the next attempt to form the Assembly scheduled for tomorrow. The deadline set by the Constitutional Court for the completion of the constitutive session is fast approaching.
