The Court of Appeals – General Department has approved the appeals lodged by the defense attorneys of Sergeant Ibrahim Nela and police officers Albian Retkoceri, Artidon Konxheli, Liridon Rrahmani, and Endrit Beqiri.
Acting on its official duty, the Court of Appeals has annulled the decision of the Basic Court in Pristina – Lipjan Branch, which on July 9, 2025, had ordered one month of pre-trial detention for them on suspicion of negligent homicide in the death of citizen Agon Zejnullahu in Lipjan.
Case Returned for Retrial
“The Court of Appeals of Kosovo – General Department, has approved the appeals of the defendants’ defenders I.N., A.R., A.K., L.Rr. and E.B., and, acting on official duty, has annulled the decision of the Basic Court in Pristina, Lipjan Branch – General Department, PPr.no.41/2025, dated 09.07.2025, returning the case for retrial,” states the Appeal Court’s notification, as reported by “Betimi për Drejtësi.”
According to the Court of Appeals, the judicial panel found that the appealed decision contained violations of criminal procedure provisions that necessitated its annulment.
“The Court of Appeals assessed that the appealed decision does not contain the analysis and evaluation of relevant, credible, and conclusive evidence to establish and prove that there is reasonable suspicion that the defendants committed the alleged criminal offense. Therefore, in its decision, the Court of Appeals has proposed to the first instance court to rectify all violations found in the appealed decision, returning the case for a new ruling,” the notification concludes.
