President Osmani to Submit Constitutional Comments Tomorrow: “No One Has the Right to Block Institutions”

President of Kosovo Vjosa Osmani will submit her comments to the Constitutional Court on Tuesday regarding the ongoing stalemate over the constitution of the Assembly, a process that has dragged on for weeks.

Her media advisor, Bekim Kupina, confirmed the move though he did not disclose the content of the submission. He stressed, however, that the President’s position remains clear: no one should have the right to block state institutions.

“As you know, the Constitutional Court has already imposed an interim measure until September 30. Regarding the merits of the case, the President will submit her comments to the Court within the set deadline, tomorrow, September 9. The President’s consistent stance has been that no one should be allowed to block the functioning of institutions, and consequently the state. As Article 57 (4) of the Constitution stipulates, the realization of community rights is inseparable from the duty to respect the laws of the Republic of Kosovo and not infringe upon the rights of others,” Kupina stated.

Last week, the Court issued an interim suspension until September 30, barring newly elected MPs from taking further steps and preventing any procedure for forming a new government. The measure came following a request by Serb List deputies and was applied ex officio.

The controversy began when the newly elected Speaker of the Assembly, Dimal Basha, declared the constitutive session closed on August 30, even without the election of the Serbian deputy speaker — a move that prompted Serb List to take the case to the Constitutional Court.
