Prosecution Does Not Oppose Admission of Wesley Clark’s Statement as Evidence in Thaçi Case

The Specialist Prosecutor’s Office (SPO) has stated through a submission that it does not oppose, in principle, the admission of General Wesley Clark’s statement as material evidence, provided that it meets the requirements of Rule 154.

In its submission, the Prosecution also clarified that it does not object to the modification of Thaçi’s defense evidence list to include Clark’s statement, nor to the proposed measures under Rule 107, Betimi për Drejtësi reports via Klan Kosova.

According to the SPO, since Clark’s statement contains expert opinions related to important issues in the case, the Prosecution will not oppose its admission under Rule 154. However, it emphasized that the weight of this testimony must be assessed carefully once admitted.

“For the reasons stated above, the SPO does not oppose: (i) the admission of the proposed evidence in the Request, provided that the requirements of Rule 154 are met; (ii) the request to amend the list of exhibits; or (iii) the proposed measures under Rule 107,” the submission reads.

Earlier, on April 15, 2025, the Prosecution announced that it had completed the presentation of its evidence in the case. The defense then filed a motion under Rule 130, seeking the dismissal of certain charges in the indictment.

On July 16, 2025, Presiding Judge Charles Smith III rejected this motion, explaining that the challenged incidents — those occurring before May 1998 and after June 20, 1999 — were not charges in the sense of Rule 130, and therefore the panel had no authority to dismiss them based on temporal scope.

That same day, the Victims’ Counsel presented its evidence, calling two expert witnesses, whose testimony concluded on July 17, 2025, marking the end of the victims’ defense witnesses.

The Specialist Prosecutor’s Office had previously, on September 30, 2022, filed a revised confirmed indictment against Hashim Thaçi, Kadri Veseli, Jakup Krasniqi, and Rexhep Selimi, containing ten counts of war crimes and crimes against humanity.

Earlier, on April 29, 2022, the SPO had submitted an amended indictment alleging that the four accused also committed war crimes in Gjilan, Budakovë, and Semetishtë.

All four — Thaçi, Krasniqi, Veseli, and Selimi — have pleaded not guilty to the charges during their initial appearances in November 2020. The indictment was officially confirmed on October 26, 2020.
