Radoičić Still Without Official Indictment in Serbia

Despite admitting responsibility for organizing the attack in Banjska, Milan Radoičić has yet to be formally indicted by Serbian authorities.

According to Serbian lawyer Ivan Ninić, the process is being delayed to ease international pressure on Serbia. He believes that Radoičić may not face justice in Belgrade at all or, if he does, it could be part of a political agreement.

Although the High Prosecutor’s Office in Belgrade announced an indictment over a month ago, no decision has been made so far.

Two Possible Scenarios for Radoičić’s Trial

Ninić emphasizes that if Serbia aims to join the European Union, it must take responsibility for Radoičić’s actions and ensure accountability. However, he points out that the Belgrade Prosecutor’s Office lacks jurisdiction over Radoičić, as Serbia recognized Kosovo’s judiciary by signing the Brussels Agreement.

He outlines two possible outcomes: Radoičić could be tried in absentia in Prishtina or face potential detention. The political background of the operation remains unclear.

“The Banjska attack should never have happened, and it wouldn’t have if the authorities in Belgrade were unaware, uninvolved in its organization, or hadn’t given the green light. The question is: will we ever uncover the true purpose behind Banjska?” Ninić stated.

He further noted that the Banjska attack had serious political consequences for Serbia. While the High Prosecutor’s Office has yet to provide clear information on the investigation, experts believe that any eventual legal process may be the result of a political agreement.
