Special Prosecution Indicts Former Minister Damka and MARD Official for Abuse of Office

PRISTINA, Kosovo – July 3, 2025 – The Special Prosecution has filed an indictment against defendants F.D. and B.K. for the criminal offense of “Abuse of Official Position or Authority.”

Allegations of Illegal Funding and Budget Damage

F.D., in his capacity as Minister of the Ministry of Regional Development (MARD), and B.K., as acting secretary of the same ministry, are accused of exceeding their legal competencies between August 16, 2021, and March 24, 2022. Their alleged aim was to provide financial benefit to two non-governmental organizations, “Germin” and “Caritas Swiss.”

According to the indictment, the defendants acted contrary to the Law on International Agreements and Public Financing Procedures for NGOs, and beyond the Ministry’s competencies. They allegedly exceeded the limits for NGO funding from public funds by financing the aforementioned organizations without issuing a public call.

There is well-founded suspicion that the defendants caused damage to the budget of the Republic of Kosovo in the amount of €1,040,000.

Prosecution Seeks Fines and Imprisonment

The Special Prosecution has proposed to the Basic Court in Pristina that, following the judicial review, the defendants be found guilty and sentenced to fines and effective imprisonment. The prosecution argues that only these types of sentences will achieve the purpose stipulated in Article 38 of the Criminal Code of the Republic of Kosovo.
