Supreme Court Declares Certain Provisions of University of Prishtina Statute Unlawful

The Supreme Court of Kosovo has struck down several provisions of the Statute and Regulations of the University of Prishtina “Hasan Prishtina”, which automatically barred the employment of candidates who had family members in the same academic unit.

In its ruling on December 10, 2025, the Court sided with the plaintiff, B. P., noting that these prohibitions violated constitutional principles of equality as well as existing laws on employment and conflicts of interest.

With this decision, the Supreme Court has declared unlawful and repealed:

  • Article 153, paragraphs 3 and 4 of the University Statute, which prohibited the selection of candidates who had family members employed in the same academic unit.
  • Article 7, paragraph 6 of Regulation no. 2/254, which imposed specific restrictions on hiring external collaborators with family ties (such as parent-child, siblings, etc.).

This ruling reinforces the principle of equality in employment and ensures that family relationships alone cannot automatically disqualify candidates from positions at the University.
