Supreme Court overturns the Court of Appeals’ decision, recognizes the UÇK veteran’s pension rights

The Supreme Court has overturned the decision of the Court of Appeals, recognizing the plaintiff K.J.’s right to the Kosovo Liberation Army (UÇK) veteran’s pension.

As the Supreme Court announced, this right is recognized from the date the pension was terminated, June 28, 2021, and remains valid as long as the legal conditions are met.

“The Supreme Court panel has approved as grounded the revision submitted by the plaintiff K. (I.) J., from D., R. e Sh., and has modified the judgment of the Court of Appeals, recognizing the plaintiff’s right to the personal pension of a UÇK war veteran. From the case files it results that the Ministry of Finance, Labour and Transfers – the Department for Families of Martyrs, War Invalids, and Civilian Victims – had rejected as unfounded the appeal of K.J. requesting recognition of the right to a personal pension as a UÇK Veteran–Fighter,” the announcement states.

The Court notes that after his initial claim was rejected by the lower judicial instances, and following the Court of Appeals decision AA.nr.436/2024 dated 10.03.2025, the plaintiff, through the Free Legal Aid Agency, submitted a revision to the Supreme Court.
