The Supreme Court of Kosovo, in an administrative conflict case filed by L.F., A.V., A.L.Z., Xh.I., P.Gj., L.B., H.S., M.R., A.I., S.T., represented by attorney Ardian Bajraktari, against the Office of the Prime Minister and the Kosovo Agency for Medicinal Products and Medical Devices (AKPPM), represented by the Ministry of Justice – State Attorney, has partially upheld the plaintiffs’ claims in its public hearing held on September 22, 2025.
The Court declared unlawful and repealed Regulation (ZKM) No. 04/2025 on the internal organization and job classification of the AKPPM, which was published in the Official Gazette on April 18, 2025.
However, the remaining requests of the plaintiffs were rejected, including:
- The request to compel AKPPM to issue a new sub-legal act in accordance with legal provisions.
- The request for a temporary measure to suspend the legal effects of the Regulation until a merit-based decision is made.
The decision clarifies that while the Regulation has been annulled, no immediate replacement or suspension measures were ordered.
