At the Basic Court in Prishtina on Wednesday, the session against the three defendants in the September 24, 2023, terrorist attack in the village of Banjskë, Zveçan — Vladimir Toliq, Dushan Maksimoviq, and Blagoje Spasojeviq — was adjourned. The Court will attempt to secure the testimony of witness Goran Tanevski through the Court of Skopje.
During this session, the Court accepted the proposal to hear witness Millosh Radosavleviq and decided to read the interrogation record of witness Dragana Antijeviq.
According to the agenda, Dragana Antijeviq was scheduled to testify; however, Judge Arben Hoti noted that the summons had been received twice by her father, who informed the Court that she was in Serbia.
Prosecutor Naim Abazi proposed that Antijeviq’s prior statement be read, arguing that she had repeatedly refused to appear without a legal reason. Abazi noted that the Code of Criminal Procedure allows prior statements to be read if a witness refuses to testify without justification.
“The procedural conditions are met, as she gave a statement to the Prosecution, and the requirements for applying this record in accordance with Article 239 of the Criminal Procedure Code are fulfilled, respecting the principle of equality of arms in favor of the defense,” Abazi explained. He proposed that the statement be read and admitted as direct evidence in the trial.
Alban Rashiti’s lawyer, Naim Rudari, representing the injured party, supported the prosecutor’s proposal.
Defense lawyer Lubomir Pantoviq, representing Spasojeviq, stated that the statement was irrelevant to his client and did not object to its reading. Similarly, Jovana Filipoviq, representing Maksimoviq, acknowledged the statement might not directly concern her client but supported its inclusion.
Judge Hoti emphasized that efforts had been made to secure Antijeviq as a witness, but she was not in the territory of Kosovo, and therefore her prior statement would be read. Regarding Goran Tanevski, attempts to connect via video link with the Skopje Court were unsuccessful, leaving this matter pending for a future session.
The Court also received a late proposal from defense lawyer Filipoviq for a witness, Millosh Radosavleviq, which was approved, with the Court citing its authority to accept additional evidence at this stage of the proceedings.
The next session is scheduled for January 16, 2026. The October 27, 2025 session had been canceled because the Skopje Court lacked the necessary equipment for the witness testimony.
The Basic Court in Prishtina previously rejected the proposal to continue the trial in absentia for the remaining 42 defendants (41 individuals and one legal entity). International arrest warrants have been issued for these defendants.
The trial against Toliq, Maksimoviq, and Spasojeviq began on April 17, 2025, where all three pled not guilty. The Special Prosecution of Kosovo indicted a total of 44 individuals and one legal entity, “RAD D.O.O.,” with Milan Radoiçiq leading the list.
The indictment charges that on September 24, 2023, the accused attempted, using armed violence, to separate the northern part of Kosovo and annex it to Serbia, resulting in the death of police officer Afrim Bunjaku and endangering the lives of other police officers and civilians. Three attackers were killed, and others fled, taking shelter for several hours in the Banjska Monastery. Milan Radoiçiq claimed responsibility for the terrorist attack.
