Constitution drafter Arsim Bajrami stated that he was opposed to the establishment of the Special Court, calling it monoethnic, as it deals only with alleged crimes committed by the Kosovo Liberation Army (KLA) and never with the crimes of Serbian genocide.

He emphasized that there had been extraordinary pressure to form this court and even threats that if the Kosovo Assembly didn’t establish it, the UN Security Council would.

“At the time, I also advised Thaçi and others that it would be better for the Security Council to do it than for us to approve a court with our own votes — one that aims to rewrite the history of Kosovo. We were faced with a fait accompli,” Bajrami said.

Furthermore, academician Bajrami stated that he has provided exculpatory evidence and has submitted video footage, as he is closely cooperating with the defense team.

“Over the years, I have followed the work of this court and offered a lot of exculpatory evidence. I have submitted materials, and I personally deposited videos,” Bajrami said in an interview with Klan Kosova.

He reiterated that the KLA’s war was a liberation war and not part of any criminal enterprise.

“The KLA war was a liberation struggle, and there is no talk of any criminal organization. If we study the KLA, we see that it was a voluntary guerrilla force without a state behind it — acting on patriotic grounds to defend the people,” he said.
