The panel of the Supreme Court in The Hague issued the decision on Sali Mustafa’s request for protection of legality, where he raised five points related to the translation of the appeal judgment into Albanian, his conviction for murder as a war crime, as well as the measure of punishment.
“In his request for legal protection, Mr. Mustafa raised five points, which were related to the translation of the appeal judgment into Albanian, his declaration of guilt for murder as a war crime, as well as the measure of punishment.”
The Specialized Chambers in The Hague have announced that his request has been partially approved and the part of the appeal verdict that deals with Mustafa’s 22-year prison sentence has been annulled.
The announcement states that the panel of the Supreme Court has returned the case to the appeal panel to consider the reduction of the sentence.
“The panel of the Supreme Court partially approved his request and annulled the part of the appeal judgment that deals with the conviction of Mr. Mustafa with 22 years in prison. The Supreme Court Panel remanded the case back to the Appellate Panel pursuant to Rule 194(1)(b) of the Rules, to consider a reduction of the sentence based on the reasoning set out in the Supreme Court Panel’s decision.”
