U.S. President Donald Trump has asked the Supreme Court to overturn a lower court ruling that deemed many of his sweeping tariffs unlawful.
In a petition filed late Wednesday, the Trump administration requested that the justices intervene promptly to determine whether the president has the authority to impose such import taxes on foreign countries, according to the BBC.
Last week, the U.S. Court of Appeals for the Federal Circuit ruled 7-4 that the tariffs Trump imposed under the International Emergency Economic Powers Act (IEEPA) exceeded the president’s authority, stating that the power to levy such taxes is “a core power of Congress.”
The case could overturn Trump’s economic and foreign policy agenda and potentially require the U.S. to refund billions in tariffs.
Trump justified the tariffs under the IEEPA, which grants the president authority to act against “unusual and extraordinary” threats.
In April, Trump declared an economic emergency, arguing that a trade imbalance had harmed domestic manufacturing and posed a risk to national security.
The appellate court, however, ruled against the president.
