What Happens After 30 Days? Former Constitutional Court Judge Kadri Kryeziu Speaks

The Constitutional Court of Kosovo yesterday issued a ruling obliging political entities to fulfill their constitutional duty to constitute the Assembly of the Republic of Kosovo within 30 days.

In an interview last night on Klan Kosova, former Constitutional Court Judge Kadri Kryeziu stated that if this obligation is not met within the specified deadline, it will constitute a violation of the Constitution by all deputies.

“If it’s not done, then it’s confirmed that the Constitution has been violated, and the Constitution isn’t violated by an individual, but by the institution. Here, the Constitution is violated by all deputies, from the first to the last,” Kryeziu said.

He added that the Constitutional Court does not have a direct mechanism for enforcing its decisions. However, he clearly emphasized that the failure to implement the decision constitutes a criminal offense.

According to the Criminal Code of the Republic of Kosovo, obstruction or non-implementation of constitutional obligations, such as the constitution of the Assembly, can be punishable by imprisonment ranging from 3 to 6 years.
