The next Government of Kosovo may be formed without the Serbian List if the Central Election Commission confirms the current results of the February 9 elections, according to which one of the ten parliamentary seats – reserved for the Serbian community – went to Nenad Rašić’s Party for Freedom, Justice, and Survival.
This was stated by Eugen Cakolli from the Democratic Institute of Kosovo.
This would be the first time that the Serbian List would not be part of the Government of Kosovo since its formation in 2013, as until now, it has won all ten seats reserved for the Serbian community.
According to the Constitution of Kosovo, a ministerial position in the Government of Kosovo is reserved for the Serbian community, while another is reserved for other non-Serb minority communities.
Additionally, if the Government of Kosovo consists of more than twelve ministers, an additional minister is appointed from non-majority communities.
The selection of these ministers is done in consultation with parliamentary parties, and if someone is appointed from parties that did not enter the Assembly, official approval is required from the majority of deputies of the community from which the minister is appointed.
Based on this constitutional article, Cakolli states that a government without the Serbian List – if the current preliminary results are confirmed – would certainly be legitimate in legal terms, but consultations would need to be held with all parliamentary parties, including the Serbian List.
