The defendant, Ramadan Berisha, has pleaded not guilty to charges of inciting hatred, division, and intolerance. He is accused of having posted content on Facebook targeting a citizen of Bosniak nationality, alleging that the individual and his brother had joined the Serbian army and fought against Albanians.
“Not guilty,” Berisha stated during the initial hearing on Thursday at the Basic Court in Pristina, following the reading of the indictment by prosecutor Fikrije Krasniqi-Fejzullahu, reports Betimi për Drejtësi.
The presiding judge, Kushtrim Shyti, informed the parties that within a 30-day deadline they may submit objections to the evidence and file a request for dismissal of the indictment.
Judge Shyti also announced that the case had been transferred from the Basic Court in Peja to the Special Department of the Basic Court in Pristina, after being taken over by the Special Prosecution of Kosovo.
According to Shyti, the original indictment was filed by the Basic Prosecution in Peja on June 8, 2023, while on January 21, 2026, the Special Prosecution submitted an amended indictment.
Based on the amended indictment dated January 21, 2026, Berisha is accused of having, on March 3, 2022, in the village of Zllapek, Municipality of Peja, publicly incited and spread hatred, division, and intolerance among ethnic groups through a Facebook post, harming the injured party M.D., a Bosniak citizen.
The indictment states that the content of the post read:
“M.D., from the village of Treboviq, Municipality of Peja, Kosovo, born in 1988, voluntarily wore the Serbian uniform and joined the army, fighting bravely against Albanians. Later, his brother joined the army and also fought bravely against Albanians. Later, his brother joined as well and was wounded not far from the city of Peja, in Vitomerica. Brave fighters should never be forgotten!!!”
As a result of these actions, Berisha is charged with the criminal offense of “Incitement of Hatred, Division, and Intolerance”, under Article 141, paragraph 1 of the Criminal Code of the Republic of Kosovo.
