The Basic Court in Prishtina has issued a conviction in the case of Ylber Jashari, accused of abuse of office, and Bekim Baftijaraj, accused of illegal construction work related to the incident of the roof collapse at the Municipality of Prishtina, which resulted in serious injury to a citizen.
Jashari was sentenced to 3 years in prison and a fine of 5,000 euros, while Baftijaraj was sentenced to 2 years in prison.
Jashari is accused of acting in his official capacity as the Contract Manager for the “Roof Reconstruction of the New Municipality Building” project, worth a total of 386,096.20 euros. He is accused of exploiting his position and authority to unlawfully benefit the company by approving a report falsely claiming that the roof work had been completed, despite the fact that the work was not carried out according to the contract in specific sections (2.2, 2.3, 5.1.5.13, and 5.14). This allowed payments to be made to the company, which led to a financial loss of 36,450.29 euros from the budget of the Republic of Kosovo. This action led to a conviction for abuse of office or official authority.
Baftijaraj is accused of being responsible for overseeing and carrying out construction work related to the roof reconstruction project. He is alleged to have acted contrary to standard professional practices and the contractual terms, performing work that deviated from the agreed-upon specifications. On the critical day, due to weather conditions and the impact of wind, a portion of the roof of the New Municipality building collapsed onto the road, sidewalk, and surrounding area, injuring the citizen E.U. This caused material damage to five parked vehicles around the building and financial damage of 36,450.29 euros to the budget of the Republic of Kosovo. Baftijaraj was convicted for performing illegal construction work.
