Kosovo’s former Minister of Justice calls for Milan Radojičić and other fugitives to be tried in Kosovo, with or without extradition.

Albulena Haxhiu, the former Minister of Justice in Kosovo, has called for the immediate trial of Milan Radojičić, the alleged leader of the Serbian List, and other suspects involved in the Banjska terrorist attack. Haxhiu emphasized that Radojičić, as the de facto head of the Serbian List, must face justice in Kosovo, with or without extradition, stressing the importance of a direct legal confrontation.

Speaking on the issue, Haxhiu stated that the trial in absentia could be considered, but Radojičić’s direct surrender would provide greater value, allowing him to face justice in Kosovo’s courts. Haxhiu also highlighted Radojičić’s pivotal role in orchestrating attacks that undermine Kosovo’s constitutional order, citing his involvement in key events like the 2023 Serbian Army parade in Batajnica, which exposed the FK-3 Chinese system and marked the location where 744 Albanians were exhumed from a mass grave.

“This became even clearer when the formal leader of the Serbian List, Zlatan Elek, was ranked seventh in the February 9 elections, and after receiving the deputy mandate, he was forced to resign,” said Haxhiu. “Certifying the Serbian List for the last elections was a grave and unforgivable mistake.”

In related developments, the Basic Court of Pristina rejected the request of the Kosovo Special Prosecutor’s Office to have the suspects of the Banjska attack tried in absentia. The court found the request unfounded, ruling that conditions for an absentia trial were not met.

The court emphasized that the trial will continue once the defendants are arrested or extradited. Prosecution has the right to appeal this decision to the Court of Appeals of Kosovo.

Haxhiu’s statement comes as the legal and political tension surrounding Kosovo’s sovereignty and the influence of external forces like Serbia remains high. Kosovo authorities continue to press for accountability and justice, especially for the families affected by the Banjska attack and other acts of terrorism in the region.
