The Supreme Court of Kosovo has rejected as unfounded the lawsuit filed by the Municipality of Prishtina seeking a temporary suspension of the Regulation on Amendments and Supplements to the Regulation on Waste Management.
The regulation, adopted by the Municipal Assembly on December 1, 2023, amended on December 5, 2024, and published in the Official Gazette on December 31, 2024, requires that all payments for waste management services be made directly to KRM “Pastrimi” Sh.A.
The Municipality’s request, under the leadership of Mayor Përparim Rama, aimed to halt the implementation of this regulation temporarily. However, the Supreme Court ruled that there is no legal basis to prevent the regulation from producing legal effects, emphasizing that the suspension of a sub-legal act cannot occur without a final decision on its legality.
This ruling effectively rejects the Municipality’s attempt to delay the regulation’s implementation until a final verdict is issued and upholds the current legal obligation for residents to pay directly to “Pastrimi.”
Moreover, the Court stated that the decision takes immediate legal effect upon notification of the parties, thereby temporarily concluding the dispute over the regulation’s implementation.
This means the regulation remains in force and must be implemented until a possible future ruling on its substantive legality.
