In an unprecedented legal preemptive strike, former CIA Director John Brennan has filed a federal lawsuit against President Donald Trump and top officials within his administration. The lawsuit, filed in a Washington, D.C. federal court, seeks an emergency injunction forcing the government to preserve all records tied to investigations into what Brennan terms a “phantom crime.”
According to reports by NBC News, Brennan’s legal team argues that these internal documents are absolutely vital to building a defense against an anticipated, politically motivated “retaliatory prosecution” by the Trump administration.
A Defense Built on Presidential Rhetoric
Brennan’s attorneys assert that any future criminal indictment brought against the former intelligence chief would be entirely fraudulent and weaponized. The lawsuit leans heavily on the public record, pointing to more than 100 oral or written statements made by Donald Trump since 2017 that publicly vilify Brennan.
The lawsuit alleges that the President has issued sweeping directives to the Department of Justice (DOJ) to initiate criminal proceedings against his former critics, “regardless of any factual or legal justification.”
“To fully evaluate these claims, a reviewing judge would need to examine the motivations of the Department of Justice officials who undertook these actions,” Brennan’s attorneys wrote in the court filing. “This is necessary to determine whether they violated Director Brennan’s rights, and specifically whether they were motivated by a desire to prosecute him vindictively as an act of retaliation.”

The federal lawsuit specifically targets Donald Trump alongside his core circle of loyalist law enforcement and intelligence appointments. The list of high-ranking defendants includes:
- Acting Attorney General Todd Blanche
- FBI Director Kash Patel
- Federal prosecutors in Florida who are actively overseeing expanding grand jury investigations into former Obama-era officials.
The Florida Investigations: What Brennan Faces
The lawsuit officially confirms that Brennan is currently the target of at least two separate federal investigations running out of Florida:
- The Congressional Statements Probe: This investigation is examining whether Brennan made fraudulent or perjured statements to Congress regarding a classified intelligence assessment that documented Russian state interference in the 2016 presidential election to aid Trump’s victory over Hillary Clinton.
- The “Deep State” Conspiracy Probe: A broader, highly politicized investigation looking into whether a network of former law enforcement and intelligence officials actively conspired to undermine Trump’s presidency through the cross-agency launch of the original Russia probe.
