Kosovo Constitutional Court Rules on Public Officials Law

The Kosovo Constitutional Court has ruled on the request regarding the Public Officials Law, affirming that the contested provisions are in line with the Constitution. The court ruled that the law, specifically paragraphs 3, 4, and 5 of Article 18 (Transitional Provisions), do not violate the Constitution of Kosovo and have no conflict with several constitutional rights, including property rights, equality before the law, and the right to work.

The court’s ruling clears the way for the law to be sent to the President of Kosovo for promulgation. The judgment also affirmed that the law does not violate the rights of civil servants with indefinite-term mandates, particularly regarding changes to their status as proposed in the law.

The ruling will take effect once published in the Official Gazette of the Republic of Kosovo.
