Kosovo lawyer Arianit Koci has referred the election of Justina Shiroka-Pula as president to the Constitutional Court, arguing that the vote continued beyond the deadline he says was set by the court.
Koci said he submitted a notification to the Constitutional Court concerning what he described as the non-implementation of the court’s judgments in cases KO256/26 and KO258/26.
According to Koci, the Constitutional Court had determined that the procedure for electing Kosovo’s president had to be completed by October 6, 2026. He argued that publicly available information showed the voting continued after midnight.
“The Court had clearly determined that the procedure for the election of the President had to be completed by October 6, 2026,” Koci wrote in a Facebook post.
He also referred to Article 226 of the court’s judgment, which he said sets out the legal consequence of failing to meet the deadline — the dissolution of the Assembly.
“Decisions of the Constitutional Court are binding,” Koci said, adding that, in his view, the failure to implement them undermines the rule of law.
In comments accompanying his post, Koci shared the notification he said he had submitted to the Constitutional Court.
Writing after midnight, he further argued that holding new parliamentary elections had now become a constitutional obligation.
The Constitutional Court has yet to publicly rule on Koci’s submission or indicate whether the presidential election was conducted within the applicable constitutional deadline.
