The Constitutional Court is still reviewing the case concerning President Vjosa Osmani’s decree dissolving the 10th legislature of the Kosovo Assembly, with only a few days remaining before the temporary measures expire. Analysts and legal experts say the Court’s decision will need to clarify all legal ambiguities, setting a precedent for the future.
With just eight days left before the temporary suspension on the presidential decree expires, the Constitutional Court has not yet completed its review.
In a statement, the Court said its decision will be made after examining all constitutional aspects of the claims submitted by the applicant party.
“The decision in this case will be made once all constitutional aspects of the claims submitted by the applicant party have been reviewed, in accordance with the Constitution, the Law on the Constitutional Court, and the Court’s Rules of Procedure,” the Court stated.
Legal expert Anton Nrecaj explained that, based on past practice, the Court has two possible options:
“One option is to determine that the President’s decree was unconstitutional because all possibilities to elect the President were not exhausted. Alternatively, the Court may conclude that the decree, having legal force, allows the country to hold early elections. In the second scenario, the Court could declare the decree unconstitutional but grant a 60-day period from the initiation of the presidential election procedure. If no President is elected within that period, the country would then proceed to early elections,” Nrecaj said.
Analyst Afrim Kasolli emphasized that the Court must resolve all uncertainties surrounding the presidential election process.
“Whatever the Constitutional Court decides, it cannot ignore this dimension and must clarify how the Kosovo Assembly should act when faced with a clear constitutional obligation,” Kasolli said.
The Constitutional Court’s temporary measure, in place until 31 March, suspended all presidential actions regarding the dissolution decree and blocked any parliamentary action in the matter.
The decree was issued after the Assembly failed to elect a President by the last day of the constitutional deadline, while President Osmani’s term is set to end on 4 April.
