Kosovo Constitutional Court Rejects President Osmani’s Request Regarding CEC Members

The Constitutional Court of Kosovo has ruled that the request submitted by President Vjosa Osmani concerning a competence conflict over the appointment of the Central Election Commission (CEC) of Kosovo members is inadmissible.

The request (Case No. KO81/26) sought the Court’s assessment of a “conflict between constitutional competencies under Article 113 (3) (1) of the Constitution of Kosovo,” specifically between the President and the parliamentary groups of the Assembly of the Republic of Kosovo regarding the appointment of CEC members.

The Court unanimously decided:

  1. To declare the request inadmissible.
  2. To reject the request for a temporary measure.
  3. To notify all parties of this decision.
  4. To publish the decision in the Official Gazette of the Republic of Kosovo in accordance with paragraph 4 of Article 20 of Law No. 03/L-121 on the Constitutional Court.
  5. To establish that this decision enters into force immediately, pursuant to paragraph 5 of Article 20 of the same law.
