Professor of Law Flamur Hyseni told RTK that the election of Justina Shiroka-Pula as President of Kosovo did not constitute a constitutional violation.
Commenting on the presidential election process, Hyseni said that in a parliamentary system, political agreements can be reached at any point, including at the end of a constitutional deadline.
“It is always possible to reach an agreement at any moment and then produce a decision, which is what happened last night. It does not matter much whether it happens at the beginning, in the middle or at the end. What matters is that an agreement was reached and that there was full consensus on the positions needed to carry out a procedure and secure the high majority required by the Constitution,” Hyseni said.
According to him, the election of the president has created a new legal and political fact, and Shiroka-Pula officially received her mandate from the moment she was elected.
Hyseni described the election of the president as the conclusion of the process of establishing the country’s central institutions, following the constitution of the 11th Legislature and the formation of the government.
He said he saw no constitutional issue, stressing that the procedure had been completed within the prescribed deadlines.
“We are within the deadlines. The Constitution continues to apply; it is the highest-ranking act in the hierarchy of legal acts in force,” Hyseni said.
