Supreme Court Upholds “Prishtina Parking” Regulation

The Supreme Court has made a decision regarding the request from the Group for Legal and Political Studies (GLPS) for a temporary measure on the Regulation for the Organization and Use of Parking Spaces in the Municipality of Pristina, which governs the operations of “Prishtina Parking.”

“The request for the imposition of a security measure has been rejected, and regarding the filing of the lawsuit, a court hearing will be scheduled soon once the legal conditions are met,” stated the court’s response.

Last Monday, GLPS filed a lawsuit with the Supreme Court, requesting the annulment of the “Prishtina Parking” regulation. They also sought for the court to impose a ban on all legal effects of this regulation.

Regarding this measure, the Supreme Court had seven working days to make a decision, based on the Law on Administrative Conflicts under which the lawsuit was filed.

In the lawsuit, GLPS identified 9 articles of the regulation that they believe contradict various laws, including traffic laws.

The organization also deemed as illegal the article regarding the imposition of wheel clamps by “Prishtina Parking” controllers and the confiscation of vehicles. Additionally, GLPS contested Article 12 of the Regulation, which states that “Prishtina Parking” is not responsible for any damage caused to vehicles parked in spaces under its management, nor for compensating any potential damages.

According to the plaintiff, this provision strips “Prishtina Parking” of responsibility for compensating damages, allowing the company to profit while offering no security for parking users.
