Political Deadlock, Experts: The President Has the Competence to Intervene

The President can intervene in the current political situation as the defender of the constitutional legal order in the country, according to constitutional experts.

Professors Kadri Kryeziu and Muhamet Kelmendi, in their analysis on RTK’s Special program, stated that, according to Article 84, paragraph 2, Article 113, and the fifth point, the President has the competence to intervene.

The current political deadlock in Kosovo, according to the professors and constitutional experts, arises from political immaturity.

Kadri Kryeziu, a former judge at the Constitutional Court, believes that delays in resolving the political crisis could have serious political, economic, and international consequences.

“We had a special representative, and the democratic world has considered us independent in making decisions, especially political ones, given that a long time has passed since we declared independence. I believe that the President’s powers should be exhausted, and the world will look at us while the President could do something. If not, I am convinced that intervention is needed due to the political, economic, international, and social consequences. One day, I recommended that they not meet until they reach an agreement,” said Kryeziu.

Professor Muhamet Kelmendi stated that the President of Kosovo, Vjosa Osmani, with her legal competencies, should address the Constitutional Court.

“I regret the situation we have fallen into, and I see two constitutional and legal bases for the President to act. According to Article 84, paragraph 2, the President guarantees that the institutions of Kosovo should function, and Article 113, point five, should request from the Constitutional Court regarding such matters because this is a constitutional issue,” said Kelmendi.

This political situation was not foreseen by the constitution. Only after the establishment of the Assembly can the initiative be taken for changing the rules and setting deadlines, as stated in RTK’s Special.
