Besim Kelmendi, who was dismissed from his position as Acting Chief Prosecutor of Kosovo, has filed a lawsuit against the Kosovo Prosecutorial Council (KPC).
Through the lawsuit submitted to the Pristina Court, Kelmendi is requesting interim measures and the annulment of the KPC’s decision to remove him.
Kelmendi was dismissed on 20 November 2025 during a KPC meeting, where five members voted in favor of his removal. Kelmendi and some other KPC members have contested the decision as illegal.
In his lawsuit, Kelmendi emphasizes that the interim measure is necessary to preserve the current legal situation, prevent serious and irreversible damage, and ensure that the judicial process is conducted properly.
“The purpose of this measure is to maintain the existing legal status, prevent serious and irreversible harm until the merit-based decision is made, and ensure that the judicial process is fully meaningful,” the lawsuit states, as seen by KALLXO.com.
The KPC subsequently appointed Prosecutor Agron Çalaj as Acting Chief Prosecutor. The members who voted for Kelmendi’s dismissal were Ardian Hajdaraj, Jehona Grantolli, Jetish Maloku, Arjana Shajkovci, and Milot Krasniqi. Members Arian Gashi, Visar Krasniqi, Besim Kelmendi, and Dardan Vuniqi left the meeting and did not participate in the vote.
Kelmendi argues that the interim measure does not conflict with the public interest but is essential to avoid irreparable legal consequences pending the court’s decision on his case.
