Energy Regulator to Implement Supreme Court Ruling on Electricity Market Liberalization

The Energy Regulatory Office (ERO) has voted to implement the ruling of Kosovo’s Supreme Court, which ordered the annulment of two provisions related to the liberalization of the electricity market.

The decision was confirmed during a board meeting held on Thursday, where ERO members approved the execution of the Supreme Court judgment that invalidates Articles 2 and 8 of the Guideline on Amendments to the Electricity Market Liberalization Framework.

Supreme Court Found Legal Inequality and Uncertainty

The Supreme Court ruling, published on November 5, upheld a complaint filed by the Kosovo Chamber of Commerce against the Energy Regulatory Office. The court concluded that the contested provisions created legal inequality and uncertainty for consumers, particularly businesses, and were not aligned with applicable legislation.

According to the ruling, the annulled articles undermined legal certainty in the liberalized electricity market and placed certain market participants at a disadvantage, prompting the court to order their removal.

Renewable Energy Support Mechanism Approved

In the same session, the ERO Board unanimously approved, with five votes in favor, the Regulation on the Renewable Energy Support Mechanism, providing a framework for promoting investment in renewable energy sources.

Additionally, the board authorized 43 private businesses to obtain permits for self-consumption of electricity, enabling them to produce and consume energy independently under the regulatory framework.

The Energy Regulatory Office stated that it remains committed to aligning its regulatory acts with court rulings and ensuring a transparent, fair, and legally compliant electricity market in Kosovo.
