What Happens if the President’s Decree Is Ruled Lawful or Unlawful?

Lawyer Arbër Jashari has stated that the Constitutional Court of Kosovo may either decide on the legality of the decree issued by President Vjosa Osmani or extend the suspension measure until a final decision is reached.

According to Jashari, the fate of the decree is not linked to the president’s mandate, which ends on April 4. After that, the position will be assumed in an acting capacity by the Speaker of the Assembly.

If the decree is declared lawful, elections will be held within 45 days. If it is declared unlawful, the Assembly will not be dissolved, and there could be up to two months available to elect a new president.

“The Constitutional Court has two options: either to decide on the main issue, namely the legality of President Osmani’s decree, or to extend the security measure, respectively the suspension of this decree, for a certain period until a final decision is made.

“The fate of President Osmani’s decree is not linked to her mandate. She will complete her term on April 4, after which the Speaker of the Assembly will assume the role as acting president for the following six months. If the Court rules that the decree to dissolve the Assembly was lawful, elections will be held within 45 days. If it rules that it was unlawful, then the Assembly has not been dissolved, and there will likely be a timeframe—possibly up to two months—to elect a new president,” Jashari told Rks News.
